1. General:
Business transactions with our customers, insofar as they are consumers, are subject to the following terms and conditions, unless deviations have been expressly agreed upon in individual cases.
Unless otherwise specified herein, the general legal provisions of Austrian law, such as the General Civil Code (ABGB), the Consumer Protection Act (KSchG), etc., shall apply.
These general terms and conditions are deemed to be accepted when an order is placed and form the basis of all our transactions.
Where personal references are used, these refer to both women and men equally.
2. Conclusion of contract:
The contract is concluded upon acceptance by us, either by immediately dispatching the ordered goods or by sending an order confirmation via the form on the website or by email. The confirmation of receipt of your order does not constitute confirmation of the order.
The contract language is German. Deliveries are currently only possible within Austria and to Belgium, Germany, Denmark, France, Italy, Luxembourg, the Netherlands, Poland, Sweden, Slovakia, Slovenia, Czechia and Hungary. Orders for delivery to other countries cannot therefore be accepted under any circumstances and are invalid in any case.
Our prices are in euros and include the statutory Austrian value added tax of currently 20 percent. The prices for our products shipped to Belgium, Germany, Denmark, France, Italy, Luxembourg, the Netherlands, Poland, Sweden, Slovakia, Slovenia, Czechia and Hungary include the applicable value added tax rate in those countries. Please note that the shipping costs listed in the price list are added to the prices of the goods. Price changes only take effect once the new price list has been published and only apply to orders placed after that date.
Customers outside Austria are obliged to pay any import duties that may apply to them.
3. Delivery:
The goods are normally dispatched within 1 to 3 working days (Mon-Fri) of the order being placed, or in exceptional cases within a maximum of fourteen days (in each case from dispatch of the goods), whereby 220 Grad reserves the right to announce any further delivery delays within this period, as our goods must be freshly produced. In this case, the customer is entitled to notify us that they no longer wish to receive the delivery. We reserve the right to make partial deliveries for technical reasons, unless this is excluded by the customer when placing the order, in which case any additional shipping costs incurred will be borne by us.
In any case, claims for damages due to late delivery are excluded, except in cases of gross negligence on our part.
4. Warranty and complaints:
The statutory warranty provisions apply, whereby the customer must send us the goods for inspection or replacement at our request and at our risk, whereby we will of course bear the shipping costs in the event of a justified complaint.
5. Payment:
Payment for mail order purchases can be made by credit card (Mastercard/Visa), PayPal and instant bank transfer.
6. Liability:
220 Grad shall only be liable for financial loss and damage to property if the damage was caused by us intentionally or through gross negligence. In any case, claims for damages must be made in writing within six months of becoming aware of the damage, otherwise they shall lapse.
7. Contract withdrawal:
If the contract was concluded exclusively using means of distance communication, the provisions of the Distance and Off-Premises Sales Act, Federal Law Gazette I No. 33/2014, apply.
In this case, the customer may withdraw from the contract within 14 days.
For contracts for the delivery of goods, the period begins on the day of receipt by the consumer or the third party designated by the consumer; in the case of partial deliveries, it begins on the day of receipt of the last delivery.
It is sufficient if the declaration of withdrawal is sent within the period.
Withdrawal is excluded for goods that have been specially manufactured according to customer specifications or based on the customer's personal needs, such as special blends or special roasts; furthermore, for goods that are delivered sealed and are not suitable for return for health or hygiene reasons, provided that their seal has been removed after delivery, as is particularly the case with opened coffee packages.
8. Refusal to accept delivery:
In the event of an unjustified refusal to accept delivery, we will charge a flat fee of €30.00.

10. Application of law:
Austrian law applies. Should any of these provisions be or become invalid, it shall be replaced by a valid provision that comes closest to its content.
